The victim, an 11-year-old girl, had become familiar with Kassim through occasional visits to the restaurant where she knew another individual. She referred to the offender informally as "Uncle Kassim," suggesting a perceived rapport that the adult systematically exploited. The identity of the individual through whom the victim knew the offender cannot be publicly disclosed owing to a court-imposed gag order designed to safeguard the child's privacy and wellbeing.

The girl arrived at the restaurant and positioned herself at a table where Kassim was resting in a corner section. The establishment contained other staff members and customers during this period. The initial interaction appeared innocuous when the victim requested that Kassim scratch an itchy area on her lower back, a casual request that quickly escalated into predatory behaviour. After complying with this innocent request, Kassim immediately repositioned his hand beneath the girl's shirt and asked whether he could touch her chest.
The victim's resistance to the assault was consistent and unambiguous from this critical juncture. She repeatedly voiced her refusal, uttering "no" on multiple occasions and physically leaning away from the offender to prevent unwanted contact with her upper body. Despite her clear objections, Kassim deployed his other hand to touch her, demonstrating a calculated disregard for her expressed boundaries and physical signals of non-consent. His predatory conduct intensified when the child attempted to leave the table. Rather than allowing her departure, he firmly grasped her hand and forcibly kissed her on the mouth, restricting her freedom of movement and violating her physical autonomy.
